What is ESOS?
The UK Government has established the Energy Savings Opportunity Scheme (ESOS) to implement Article 8 (4-6) of the EU Energy Efficiency Directive (2012/27/EU) which calls for mandatory energy assessments of large UK organisations. SDS was one of the first accredited companies to offer this service
Organisations that qualify for ESOS must carry out ESOS assessments every 4 years. These assessments are audits of the energy used by their buildings, industrial processes and transport to identify cost-effective energy saving measures.
Qualifying organisations must notify the Environment Agency of their compliance by the deadline of 5 December 2015. Failure to comply will result in a fixed penalty of up to £5,000 and you could be charged an additional £40,000 in daily penalties (£500/day for up to 80 days) for failure to notify compliance. Your non-compliance will also be made public and further discretionary penalties apply.
ESOS does not need to be seen as a burden to your organisation. If planned carefully, it provides an excellent opportunity to boost your energy efficiency, reduce costs and carbon emissions. Ultimately, this will set your organisation on the right path for a more sustainable future.
Does it apply to me?
ESOS applies to large UK undertakings and their corporate groups. Your organisation qualifies if, on 31 December 2014, it meets the ESOS definition of a large undertaking. Corporate groups qualify if at least one UK group member meets the criteria and all group members are required to comply.
ESOS definition of a large undertaking – An organisation that carries out trade or business which either:
- Employs at least 250 people
- Employs less than 250 people but has an annual turnover in excess of €50 million (£38,937,777), and an annual balance sheet in excess of €43 million (£33,486,489)
